Terms of Use
Last updated: 21 October 2026
Acceptance of these Terms
These Terms of Use govern your use of ObituApp. By creating an account, browsing the platform or adding content, you agree to these Terms. If you do not agree, please do not use ObituApp.
About ObituApp
ObituApp is a digital memorial platform where families and communities can share funeral announcements, tombstone unveilings and missing-person notices, offer condolences, and preserve memories in a Legacy Vault. Some features are free and others form part of paid plans.
Eligibility and accounts
You must be 18 or older, or use the platform with the consent of a parent or guardian. You are responsible for keeping your login details secure and for everything that happens under your account. Please give us accurate information and keep it up to date.
Your content and licence
You keep ownership of the content you add, such as photographs, videos, stories and condolences. By adding content you grant us a licence to host, store, display and share it as needed to run the platform, at the visibility level you choose. You confirm that you own the content or have permission to use it.
Content standards
You agree not to post content that is:
- false or misleading, including fake notices or impersonation of others;
- unlawful, hateful, harassing, defamatory or discriminatory;
- sexually explicit, violent or otherwise offensive;
- someone else's private information shared without permission;
- spam, advertising or a fraudulent fundraising or donation request.
We may remove content that breaks these standards and may suspend accounts where needed.
Memorial pages and family admins
The person who creates a memorial is its owner, and may invite family members as admins, editors or viewers. Family admins are responsible for the content and visibility of their memorial, and for the people they invite. Please treat memorial pages with the care and respect they deserve.
Condolences, media and moderation
Visitors may leave condolences, photographs and voice messages where the family allows it. Family admins can review and remove contributions. Reported content may be reviewed by our moderators, and we may hide or remove content that breaks these Terms.
Funeral partners
ObituApp lists funeral parlours and other partners. Partners are independent businesses and are not our agents or employees, and they are responsible for the services they provide. If you engage a partner, your agreement is with that partner.
Plans, payments and refunds
Paid plans unlock additional features and limits. Prices and features are shown on the Plans page and may change over time. Payments are processed by our payment provider, and where a plan auto-renews you can cancel before the next billing date. Except where the law requires otherwise, payments for a billing period already started are not refundable.
AI-assisted features
Some features use artificial intelligence to help draft or organise content. AI output may be inaccurate or incomplete. It is a writing aid only, and you should review and edit anything before you publish or rely on it.
Third-party links and services
The platform may link to third-party websites and services, such as a livestream or a donation page. We do not control them and are not responsible for their content, terms or privacy practices.
Intellectual property
The ObituApp name, logo, design and software are owned by us or our licensors and may not be copied or used without permission. These Terms do not transfer any of our intellectual property to you.
Availability and changes
We work to keep ObituApp available, but we may change, pause or withdraw features, and the service may sometimes be interrupted for maintenance. We are not liable for interruptions beyond our reasonable control.
Disclaimers
ObituApp provides a platform for sharing information and memories. It does not provide legal, medical, financial or funeral advice. Content on the platform is provided by users, and we do not verify it. The service is provided "as is" to the extent permitted by law.
Limitation of liability
To the extent permitted by law, we are not liable for indirect or consequential loss, or for loss of content or data arising from your use of the platform. Nothing in these Terms limits any right you have that cannot be limited under South African law.
Indemnity
You agree to indemnify us against claims arising from content you add or from your use of the platform in breach of these Terms.
Termination
You may stop using ObituApp at any time and may delete your account. We may suspend or end your access if you break these Terms or if we are required to by law.
Governing law
These Terms are governed by the laws of the Republic of South Africa, and the South African courts have jurisdiction over any dispute.
