Introduction

ObituApp ("we", "us", "our") is a digital memorial platform that helps families and communities share funeral announcements, celebrate the lives of loved ones, offer condolences, and preserve memories. This policy explains what personal information we collect, why we collect it, and how we look after it.

We process personal information in line with South Africa's Protection of Personal Information Act, 2013 (POPIA). By using ObituApp you agree to this policy.

Who we are and how to reach us

ObituApp is the responsible party for the personal information described in this policy. For any privacy question or request, contact our Information Officer at info@wellknowncreations.com.

Information we collect

  • Account details, such as your name, email address and role.
  • Memorial content, including the name, dates, photographs, videos, voice recordings, life stories and tributes you add.
  • Condolences and messages left on memorial pages.
  • Partner details, if you apply or register as a funeral parlour.
  • Payment information, handled by our payment provider. We do not store your full card details.
  • Technical and usage data, such as device type, browser and pages visited, used to keep the service secure and working.

Information about other people

Memorial pages often include information about the deceased and about other family members or friends. When you add this information you confirm that you have the right to share it, and where required you have the consent of those people or their families. Please only add information that should be made visible at the privacy level you have chosen.

How we use your information

  • To create, display and manage memorials, unveilings, missing-person notices and the Legacy Vault.
  • To let family members and invited guests collaborate on a memorial.
  • To send you service messages, such as updates about a memorial you follow or manage.
  • To process plan subscriptions and payments.
  • To keep the platform safe, prevent misuse and moderate reported content.
  • To improve and support the service.

Our legal basis

Under POPIA we rely on your consent, on performing our agreement with you, on our legitimate interest in running and securing the platform, and on complying with legal obligations. You may withdraw your consent at any time, although this may limit what you can do on the platform.

Sharing your information

We share personal information only as needed to run the service: with trusted service providers who host our data, send our emails and process payments; with a funeral parlour where that parlour published the memorial; and with authorities where the law requires it. We do not sell your personal information.

Public memorial pages

Some content is intentionally public. A memorial page, its condolences and other sections may be visible to anyone with the link, depending on the visibility settings chosen by the family. Family admins control what is shown publicly, what is limited to invited guests, and what is family only.

Cookies and local storage

We use cookies and local storage to keep you signed in, remember your theme and language preferences, and understand how the platform is used. You can clear this data in your browser settings, but some features may then not work as expected.

How long we keep information

We keep memorial and account information for as long as the account is active, and for a reasonable period after that to meet legal and record-keeping needs. When you delete your account or a memorial, we remove or anonymise the associated personal information, unless we are required to keep it.

How we protect information

We use appropriate technical and organisational measures to protect personal information, including access controls and encryption in transit. No method of storage or transmission is completely secure, so we cannot guarantee absolute security.

Your rights

Under POPIA you have the right to:

  • ask what personal information we hold about you and request a copy;
  • ask us to correct or delete information that is inaccurate, irrelevant or no longer needed;
  • object to processing, or withdraw consent;
  • complain to the Information Regulator of South Africa.

To exercise any of these rights, contact us at info@wellknowncreations.com.

Children

ObituApp is intended for adults. We do not knowingly collect personal information from children without the consent of a parent or guardian. If you believe a child has provided information to us, please contact us so we can remove it.

International transfers

Some of our service providers may store data outside South Africa. Where this happens, we take steps to ensure your information receives a comparable level of protection.

Changes to this policy

We may update this policy from time to time. When we make significant changes we will let you know on the platform. The date at the top shows when this policy was last updated.
